What is CBD?
Cannabidiol, also known as CBD, is one of 113 different cannabinoids found within the cannabis plant. CBD was discovered in 1940 and offers similar pain-relieving and mood-boosting benefits to THC but without the associated psychoactivity. Additionally, unlike delta 9 THC, CBD is fully federally legal and widely available, because it is also one of the most common cannabinoids found in the plant, alongside THC. This cannabinoid is most commonly consumed through oil tinctures and edibles, although topical creams, vapes, and even makeup containing CBD are available today.

How is CBD Legal?
How is CBD legal at all? Well, It all comes down to the 2018 Farm Bill, also known as the Agriculture Improvement Act of 2018. This bill changed the legal classification of hemp from a controlled substance to an agricultural commodity and made it so that any cannabis derivative containing less than 0.3% delta 9 THC would no longer be defined as marijuana in regards to the controlled substances act, effectively legalizing CBD.
Why is CBD Illegal in Some States?
As shown above, the laws surrounding CBD vary state-by-state depending on the source of the CBD, as well as its intended use. You may have noticed that CBD is highly restricted in Idaho, Nebraska, and South Dakota, and its status is still unsettled within these states. This is because the 2018 Farm Bill gave states the ability to oversee the production of hemp, also giving them the opportunity to restrict it. States like California and Colorado that enjoy legalized recreational marijuana also have the most relaxed regulations surrounding CBD.
